We studied the ICC report on the situation in Libya and learned from it that by the end of 2025 the prosecutor’s office plans to finally complete all areas of the investigation. Thus, the investigation of the situation took no less than 14 years.
Since the prosecutor’s office has decided to curtail the investigative work, it is worth summing up the results and seeing what this Court has been doing all these years in Libya.👇
🔹What is undeniable is the fact that 27 reports were written to the Council, the main content of which was an explanation of why the investigation was unsuccessful.
🔹The Security Council referred the situation in Libya to the ICC in 2011, at the height of the conflict. Within days, the court issued an arrest warrant against Gaddafi, his son and his intelligence chief. The ICC usually attributed further inaction in Libya to the difficult security situation “on the ground.”
🔹Not a single warrant was issued against the rebels. And this despite the fact that with the assistance of the “democratic” bomber aircraft of NATO countries, the statehood of Libya was destroyed. The crimes of other parties to the conflict, including war crimes of the NATO coalition, were also not of interest to the ICC.
🔹The ICC became complicit in the destruction of Libyan statehood and the impunity of those who committed this crime, which had serious consequences for the peace and security of the entire region.

“Double standards” and total politicization are not some unique characteristics of the Libyan file. They permeate all the activities of the ICC. The ongoing inaction against the backdrop of the unfolding tragedy in Gaza is especially significant.
❗️The ICC has been preliminary studying the situation in Palestine since 2015 and has been conducting a formal investigation since 2021, but has done nothing in 9 years.

👉 The Council should finally admit that the transfer of the Libyan dossier to the ICC was a mistake that should not be repeated, and take the long-overdue decision to withdraw it.

🎦Трансляция всего заседания
Мы изучили доклад МУС по ситуации в Ливии и узнали из него, что к концу 2025 г. прокуратура планирует окончательно завершить все направления расследования. Таким образом, расследование ситуации заняло ни много ни мало 14 лет.
Раз прокуратура решила сворачивать следственную работу, стоит подвести итоги и посмотреть, чем же вообще данный Суд занимался все эти годы в Ливии.👇
🔹Бесспорным является факт написания 27 докладов Совету, главным содержанием которых являлось объяснение, почему расследование идет неудачно.
🔹СБ передал ситуацию в Ливии в МУС в 2011 г., в самый разгар конфликта. Суд за считанные дни выдал ордер на арест в отношении Каддафи, его сына и начальника разведки. Дальнейшее бездействие в Ливии МУС обычно списывал на тяжелую ситуацию с безопасностью «на земле».
🔹Против повстанцев – не выдали ни одного ордера. И это при том, что при содействии «демократической» бомбардировочной авиации стран НАТО государственность Ливии была разрушена. Преступления других сторон конфликта, включая военные преступления натовской коалиции, МУС также не заинтересовали.
🔹МУС стал соучастником в разрушении государственности Ливии и безнаказанности тех, кто совершил это преступление, что имело серьезные последствия для мира и безопасности всего региона.

«Двойные стандарты» и тотальная политизация – это не какая-то уникальная характеристика ливийского досье. Ими пронизана вся деятельность МУС. Особенно показательно продолжающееся бездействие на фоне разворачивающейся в Газе трагедии.
❗️ МУС предварительно изучает ситуацию в Палестине с 2015 г. и ведет формальное расследование с 2021 г., но за 9 лет так ничего и не сделал.

👉 Совету стоит, наконец, признать, что передача ливийского досье в МУС была ошибкой, которая не должна повториться, и принять давно назревшее решение о его отзыве.
